There are two different types of adoption agencies: private and public. A private adoption agency usually works with parents who are expecting a child and wish to give that child up for adoption. Private adoption agencies can be religious, political or social organizations, and are in most cases non-profit or not-for-profit. A public adoption agency is normally run by the state or federal government, and is a medium through which abandoned or mistreated children can be moved from state custody into new adoptive homes. In the case of private adoption, adoptive children are usually infants; public adoption agencies work with children that are older, sometimes in their teens.

If you intend to pursue a domestic adoption your needs may be superior. This adoption through a state social services agency is usually straightforward, again assisted by the agency, and probably requires a general practice attorney. However, if you will be involved in a search for a child to adopt domestically, an open adoption or replacement situation, or some other situation that is largely a private matter not involving licensed agency assistance, you must retain a lawyer who is experienced and ethic in that particular area. Domestic adoption is complex and correct agreements between the parties are critical. It is very important to be sure that your adoption lawyer understands the complexities of adoption law in your state and can be an effective promoter for you with birth parents and the judiciary.

In either case, biological parents usually retain no rights to the child after the adoption papers have been signed. The adoptive parents never meet the biological parents, and neither knows the names of the other. In some cases, for birth mother adoption process the child is legally allowed to meet the biological parents following the eighteenth birthday.
